The protection of your personal data is very important to us (Heartfly). We therefore process your data exclusively on the basis of the statutory provisions (GDPR, TKG 2003). In this data protection information we inform you about the most important aspects of data processing within the framework of our website and apps.

Personal Data

Personal data that you transmit electronically on this website or via the app, such as name, e-mail address, place of residence, telephone number or other personal information, will only be used by us for the specified purpose and will be stored securely. The website provider automatically collects, stores and uses information on the web server such as the browser used, operating system, reference page, IP address, time and location of access, etc. This data cannot be assigned to specific persons without checking other data sources and we do not evaluate this data either further as long as there is no illegal use of our app or website.

Type of collection of personal data

In order to provide the services (described in the terms and conditions), it is necessary to process the following personal data.

  • First name
  • Date of birth
  • Residence/City
  • Gender
  • Profile pictures
  • Telephone number (option: if registering with telephone number)
  • E-mail address
  • Search filter (gender, age)
  • Height
  • IP address
  • Contacts (optional: Find Friends)

We offer you the option of registering or logging in with us via your Google account. If you make use of this, we will receive the data required for registration or login from Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (“Google”) (email address, name, Google Account ID and Google account profile picture).

We offer you the option of registering or logging in with us via Apple. If you make use of this, we will receive the data required for registration or login from Apple Inc., One Apple Park Way, Cupertino, California, USA, 95014 (“Apple”) (e.g. email generated by Apple address, name).

We offer you the option of registering or logging in with us using your cell phone number. For this you have to give us your cell phone number. Google will then send you an SMS with a verification code that you must enter in the app to complete the registration process. This registration service is provided by Firebase by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, in the USA. More information about Google’s privacy policy: https://firebase.google.com/support/privacy

If you decide to import your contacts, we collect data from your device’s address book or from your contacts in social media. We use this data to help you connect with contacts, for example when you use our “find friends” feature and to suggest accounts to you. If you do not want to show up in others Friend’s List (if you are in their contacts), you can disable it in the App Settings.

Sexual orientation

Users can share content with other users and send messages via the platform. You can provide information about your gender for your preferred gender in matches. This information allows other users to infer your sexual orientation.

Location data

The Heartfly App is location-based and can only be used if your location is recorded via your mobile device. This is done via consent. You can deactivate this at any time in the settings of your device.

Communication

Heartfly stores communication between users made through the app and communication between you and the support team.

If your smartphone allows it, you will receive push notifications from us when using the Heartfly services. Occasionally we will send you notifications to your E-Mail. It can be messages that we send you to fulfill a contract, or promotional information.

What data is collected?

Every time you open the Heartfly app, data from your device is automatically saved. The data includes:

  • Operating system
  • App version
  • IP address
  • Information about your wireless service provider
  • Device manufacturer
  • Date and Time
  • Device ID
  • User ID
  • Possibly User-ID or AD-ID
  • GPS location data

Processing purposes

We process your data to provide our Heartfly platform and thus to fulfill the services described in our terms and conditions. Especially:

  • Provision of the app for registered users
  • Provision of a login via the app (Google-Sign-In, Apple-Sign-In, as well as registration by telephone number)
  • Provision of a contact option via the platform
  • Enabling the conclusion of a contract
  • Sending emails or push notifications with other users.
  • Abuse Prevention
  • For self-promotion through e-mails or push notifications
  • Other communication purposes in the context of inquiries.

Disclosure of Personal Information to Third Parties

Personal data will only be passed on to third parties if this is necessary to fulfill the contract, if we have your consent or if this is necessary to fulfill a legal obligation. In addition, personal data can be transmitted to third parties:

  • to tracking technology or analytics tool providers, with prior consent
  • in connection with possible criminal acts to the competent investigative authorities
  • in the event of the sale of the business

Right to Information & Deletion

You have the right to information about the data stored about you, its origin and recipient, the purpose of storage, and the right to delete the data collected at any time. Please note that deleting the Heartfly Apps on your device does not automatically delete your personal data. If you wish to delete your personal data or request information, please send an email to support@heartfly.app. We will then delete the stored data unless it is required to be retained for accounting, dispute resolution, or fraud prevention purposes.

Modifications

We may change or update this privacy policy from time to time. If we make significant changes, we will inform you through a notice on the platform or by other means. The date “Last Updated” at the bottom of this privacy policy will reflect the date when such changes take effect.
